Shane Michael Horwitz, 31, is charged with assault, according to an arrest warrant filed by officer Chris Llewallen.
Yarber was reportedly leaving Pokey’s, a local restaurant and pub when Horwitz “jumped out of a cab and hit Mr. Yarber in the face,” noted Llewallen.
Bradley County Emergency Medical Service responded to the scene; however, Yarber reportedly refused any medical treatment.
During the initial investigation, the officer noted Yarber said “He got ‘sucker-punched’ in the eye for no reason while he was trying to leave.”
After allegedly striking Yarber, Horwitz reportedly fled the scene on foot.
Llewallen filed a warrant for Horwitz’ arrest and took him into custody later.
Horwitz was released from the Bradley County Jail after posting $500 bond.
“This was a case of mistaken identity,” said Yarber.
“I have since spoke with Horwitz’s family and they have apologized. Cleveland Police Department made an arrest and charged him with the assault but if I can, I plan on having charges dropped.”
According to Yarber, he was not acquainted with Horwitz at all.
