The bells at St. Luke’s Episcopal Church had barely finished ringing in the noon hour by the time members on the Cleveland Board of Zoning Appeals approved a setback variance for Bob and Robby Card Partnership.
The partnership requested a side setback variance of eight feet for a proposed addition to the service building at Easy Auto, at the corner of 25th and Parker streets. The potential expansion would be on the West end of the service building away from Parker Street.
Staff reported the odd shape of the property and the presence of the sewer easement crossing the property would be the most likely basis for granting the variance. The required setback in a Commercial Highway (CH) zone is 20 feet. The variance reduces the distance between the building and adjacent property to 12 feet.
The Bradley County Board of Zoning Appeals took longer to approve a setback variance of 7.9 feet requested by Wanda Calhoun. Calhoun is subdividing 3 1/2 acres on Ladd Springs Road which she plans to either sell or leave to her children.
The property is zoned Forestry/Agricultural/Residential (FAR) in which the front setback requirement is 25 feet and the requirement is 10 feet on the other three sides. However, one of the new property lines is within two feet of a structure built in the 1970s.
Staff recommended denying the request because the problem was one of the landowner’s own creation. Surveyor Jim Richmond said extenuating conditions should be enough for the board to approve the request. He said the new property line runs parallel to a driveway, which is parallel to a drainage ditch. Moving the driveway would encroach on the drainage ditch, which could not be impacted without approval from Tennessee Department of Environment and Conservation.
The four board members voted 2-1-1 in favor of the variance at the point where one corner of the building encroached into the setback area. Board members voted twice. Tim Waldrop and Cathy McCracken voted in favor of the variance on the first vote with board chair Ray Kerr and Glenna Pritchett voting against the request. On the second vote, Kerr passed to allow the variance to pass. Board member Tommy Newman was absent.
In the third meeting of the day, Cleveland Municipal Planning Commission members unanimously approved two items in a special meeting.
Eddie Botts requested to rezone 1.95 acres at the corner of Foster Lane and 20th Street S.E. from Mobile Home Parks (R4) to Low Density Single- and Multifamily Residential (R2).
The city is in the process of purchasing the property through the Community Development Block Grant program to support construction of decent and affordable housing by Habitat For Humanity for low and moderate-income occupants.
Commissioners also gave final plat approval for Stonebriar lot 22, a four-unit townhome subdivision on Stonebriar Drive located off Old Tasso Road. Staff recommended approval without comment.
