County Planning Commission denies zoning change request

Bradley County Regional Planning Commission members denied a zoning change Tuesday evening during the regular meeting in the County Courthouse.

Danny Deal requested the change at 2010 Trewhitt Road S.E., from Forestry Agriculture Residential to General Commercial. Commissioners denied the request because the property did not meet the minimum acreage for CG zoning.

Eddie Epperson spoke against rezoning the property on behalf of Trewhitt Road residents who were concerned about flooding.

“I have no idea what they want to put in there, but every time it rains, it puts about a foot of water on the (adjacent) property,” he said.

He expressed concern over where the water would flow after the dirt work was finished and a building constructed.

Bradley County Planner Bentley Thomas said there were a couple of issues with the request.

“While it is contiguous with another C-2 property, it’s right on the border of future land use designated for commercial and residential. The big issue is, it’s only .286 acres and in order to be C-2, it has to be half an acre,” he said. “This board could not approve this request tonight anyway. It would have to go before the Board of Zoning Appeals. They would have to grant a variance for the lot size and then send it back to us.”

Denied requests are not automatically forwarded to the Board of Zoning Appeals. The property owner must request a hearing. If a variance is granted, it would return to the regional planning commission.

Commissioners cleared the way for veterinarian Dr. Bart Bain to build a small animal clinic at 349 New Hope Road. The property is zoned FAR.

Bain said he has a mobile veterinary practice, but needs a better place for hospitalizing some of the small animals.

Thomas said such use is allowed by review in that zoning district.

“They have to come to you and you have to say it’s OK. You just have to make sure there are no issues, and I don’t see any issues,” Thomas said.

On the third agenda item, the commissioners approved a final plat for Duggan Living Trust. The full 10 acres will eventually be subdivided into eight parcels for each of the children. The request was to divide 4.7 acres into three parcels. Thomas said he worked with the surveyor to find the best configuration that gave all three properties legal access.

The planning commission only makes recommendations to the full Bradley County Commission.
