More than 50 attended Tuesday night’s meeting where the commission was set to decide on a revised preliminary plat for a new development for the subdivision.
The residents raised concerns about stormwater issues, whether those in the new portion would have to abide by the current homeowners association bylaws, liability issues and traffic problems.
Three of the nine member boards were not present, making the tie votes possible.
A motion was made to table a decision, but it tied with a 3-3 vote. Another motion to approve the plat also failed due to a tie vote.
Bentley Thomas, county planning director, told the residents he would research all the concerns brought to the commission and determine whether some of the concerns are best handled through other agencies instead of the planning department.
“I am going to do my best to help them resolve their concerns. I really do want to help,” Thomas said.
He added a memo would be sent with his findings to Nancy Sims, who represented the homeowners association at Tuesday’s meeting.
“I hope to have that information by the beginning of next week,” Thomas said.
Commissioners also began the process of considering changes to regulations for townhouse development.
The current regulations require townhouses be “finished,” meaning complete with walls, flooring, roofing, windows and utility systems, and lacking only final painting, wallpapering or other minor final work.
Thomas provided two versions for planning commissioners to take under advisement.
The first draft change would remove language requiring units to be completed before flats are given approval. It allows for approval once framing inspection has been done by the building inspector.
It would change the term “finished” to “built up.”
The “built up” phase contains all lots within the townhouse development which contain townhouse construction and framing inspection approval from the county building inspector.
A second version would allow approval for the entire development, prior to any construction.
The plat in this instance would show the entire townhouse development showing how all the lots on the approved site plan have been divided into individual townhouse unit lots.
A final plat would depict each individual townhouse lot and then the planning commission would grant final subdivision approval for the final plat for the entire townhouse development.
Once the plat is recorded, building of the townhouse units could proceed.
Commissioners did give approval to a rezoning request at Holloway Road SW from C-2 General Commercial District to I-1 General Industrial District.
