Local child drowns in Florida swimming pool
Devon M. Ramirez, 4, died Monday at Joe DiMaggio Children’s Hospital in Hollywood, Fla.
Margate Police Department detectives are continuing the investigation, according to Detective Efrain Suarez during a phone interview this morning.
The initial incident report was filed by Margate officer Francisco Rincon.
Ramirez’ mother Diana Giraldo said in the initial incident report by investigators that she and her children were visiting family members at a residence in Margate and Devon had been playing with a scooter and wanted to go outside to the front of the residence. The report noted Giraldo redirected Devon toward his cousin’s bedroom where the other children were playing and she “assumed Devon ... went into the room to play with the rest of the kids.”
A short time later, the children came out of the room and Giraldo noticed Devon was not with them.
The report indicated she immediately began a search and found Devon in an above-ground pool at the rear of the residence.
Family members reported hearing Giraldo scream and rushed to the pool area where Giraldo had removed the child from the pool and had begun to administer CPR.
Other family members called 911 and officials began to arrive on the scene and continued life-saving measures.
According to the report, Devon was transported to the hospital where he reportedly passed away Monday morning.
Investigators learned Monday that Child Investigator Christine Vassell of the Child Protective Investigation Services, was “there in reference to a lack-of-child supervision investigation,” according to a supplemental narrative by detectives.
According to the detective’s report, Vassell informed investigators that Giraldo “has been the subject of other child protective service investigations in Tennessee through the years,” and “based upon all of those circumstances and the death of Devon, they needed to make sure that Daniella (a sibling) was safe and being well cared for.”
The report indicates Vassell told investigators that Devon’s father, Daniel Ramirez, was responsible for Devon’s 3-week-old brother’s death. The family fled to Mexico after the 3-week-old’s death.
Daniel Ramirez entered a guilty plea in Bradley County in the July 23, 2006, death of Dylan Ramirez, Devon’s twin brother, and is serving a six-year sentence for reckless homicide in West Tennessee State Penitentiary, according to Tennessee Department of Corrections files.
Daniel Ramirez was captured by U.S. Marshals and others in Vera Cruz, Mexico, in July 2007.
According to Vassell, Giraldo was also investigated “for this incident, but the charges were dropped.”
Vassell also said that based upon the flight to another country and CPIS not being finished with their investigation, “Daniella needs to be removed from the house for her protection.”
Vassell said Giraldo packed a bag for Daniella and she was removed from the house without further incident, according to the report.
